Article 1 – Definitions
In these terms and conditions, the following definitions apply:

Cooling-off period: the period within which the consumer can exercise their right of withdrawal;

Consumer: a natural person who is not acting in the course of their business or profession and enters into a distance contract with the business;

Day: calendar day;
-
Continuous transaction: a distance contract related to a series of products and/or services, where the delivery and/or acceptance obligations are spread over time;

Durable medium: any medium that allows the consumer or business to store information directed at them in such a way that future consultation and unchanged reproduction of the stored information is possible;

Right of withdrawal: the possibility for the consumer to cancel the distance contract within the cooling-off period;

Business: the natural or legal person who offers products and/or services at a distance to consumers;

Distance contract: a contract in which, as part of a system for distance selling organized by the business, only one or more means of distance communication are used up to and including the conclusion of the contract;

Means of distance communication: a medium that can be used to conclude an agreement without the consumer and business being physically present in the same place;

Terms and Conditions: the present terms and conditions of the business.

Article 3 – Applicability
These terms and conditions apply to every offer made by the business and to every distance contract and order between the business and the consumer.
Before the distance contract is concluded, the consumer will be made aware of these terms and conditions. If it is not reasonably possible to provide the terms in advance, the consumer will be informed that the terms are available from the business and that they will be sent free of charge upon request.
If the agreement is concluded electronically, the terms and conditions can be made available electronically, ensuring that the consumer can easily store them on a durable medium.
Article 4 – The Offer

The offer is valid for the period stated in the offer and may be subject to specific conditions.

The offer contains a clear and accurate description of the products and/or services offered. Any images used will reflect the offered products as closely as possible, though colors may vary.

Any additional costs, including shipping and taxes (HST/GST), will be clearly stated.
Article 5 – The Agreement
The agreement is concluded when the consumer accepts the offer and meets any additional conditions. If the consumer accepts the offer electronically, the business will confirm receipt of the acceptance electronically.
The business will take appropriate measures to ensure secure electronic transactions and protect consumer data.
Article 6 – Right of Withdrawal
The consumer has the right to cancel the agreement within 30 days of receiving the product or having the product received by an authorized representative. During the cooling-off period, the consumer must take reasonable care of the product and packaging.
Article 7 – Costs of Withdrawal
If the consumer uses their right of withdrawal, they will bear the costs of returning the product.
The business will refund the consumer within 30 days after receiving the returned product.
Article 8 – Exclusions of the Right of Withdrawal
The right of withdrawal may be excluded for products that are personalized or perishable, or if the consumer has broken the seal on hygiene products, among other reasons.
Article 9 – Price
The prices of the products and services offered are valid for the specified period. If the prices change due to tax fluctuations or market prices, this will be clearly stated in the offer.
The business is not responsible for printing or typographical errors in the prices.
Article 10 – Conformity and Warranty
The business guarantees that products meet the description and specifications provided. The warranty provided by the business does not affect the consumer’s statutory rights.
Article 11 – Delivery and Execution
The business will deliver the accepted orders within the specified timeframe, and no later than 30 days, unless agreed otherwise. If delivery is delayed, the consumer will be informed within 30 days, and the consumer has the right to cancel the contract at no cost.
Article 12 – Duration Contracts: Termination and Extension
For contracts that are concluded for a fixed period (such as subscriptions), the consumer may terminate the contract at any time before the end of the term with a notice period of no more than one month.
Article 13 – Payment
Payments for the order must be made within 7 days after receiving the confirmation of the agreement. The business reserves the right to charge reasonable fees for late payments.
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days of discovering the defect. The business will respond to complaints within 30 days. If the complaint cannot be resolved, the consumer has the right to initiate a dispute resolution process.
Article 15 – Governing Law
These terms and conditions are governed by the laws of Canada. In the event of a dispute, Canadian courts have jurisdiction.
